The Special Rapporteur for the United Nations on Palestine, Fransisca Albanese, has accused Israel of violating the orders of the International Court of Justice concerning Gaza.
Albanese stated to the British newspaper The Guardian that “Israel seems to be violating the decisions issued by the International Court of Justice on January 26 last year, demanding it to take necessary steps to protect the rights of Palestinians and avoid any actions that could amount to genocide.”
She mentioned that she does not agree with the interpretation by some human rights activists and Israel regarding the judicial orders announced by the International Court of Justice, stating that the mentioned actions are not prohibited “as long as Israel commits them without the intention of genocide.”
The UN Official clarified that the International Court of Justice had ruled that Israel must refrain from all actions that could constitute genocide.
Later, Albanese published her interview with The Guardian on her “X” platform account, affirming that Israel is obligated to respect the court’s decisions, and it is imperative for countries to take decisive actions to prevent further injustices.
In late 2023, South Africa filed a lawsuit against Israel before the International Court of Justice, accusing Israel of failing to fulfill its obligations under the Genocide Convention of 1948.
On January 26 last year, the International Court of Justice ordered Israel to take measures to prevent acts of genocide against Palestinians, and improve the humanitarian situation in Gaza.
Israeli Prime Minister Benjamin Netanyahu responded to the court’s decision by stating that Tel Aviv “will continue the war” on Gaza, adding that the court “did not demand Israel to cease fire.”
Since October 7 last year, Israel has been waging a destructive war on Gaza, resulting in tens of thousands of civilian casualties, mostly children and women, as well as an unprecedented humanitarian catastrophe and massive infrastructure devastation, leading Tel Aviv to face charges of “genocide” before the International Court of Justice.
